GENERAL TERMS OF APPOINTMENT
Cassandra Dillon Projects (CDP) will use their best endeavours and care to ensure that the design specified is suitable for intended use but will not be responsible for costs, errors, failures and delays caused by manufacturers, suppliers, contractors, shippers, installers or users. CDP drawings and specifications are intended for a design perspective only and are not to be used for engineering purposes. The client is responsible for obtaining any and all necessary permits, licenses, or approvals required for the works.
It is the responsibility of the Client’s contractors or electrician to ensure that all recommended products are suitable for purpose and are installed correctly. CDP is not responsible for a contractor’s failure to carry out installation or construction in a workmanlike manner or in accordance with contract documents and manufacturers recommendations.
It is the client’s responsibility to confirm that products are satisfactory prior to ordering any goods from a supplier. CDP may recommend third party suppliers or contractors for the supply of goods and services. The client will be responsible for making its own assessment of the third party contractors before entering into a contract with them directly. CDP will take no responsibility for the supply of products, contractor’s services or for products ordered that are not deemed to be fit for purpose. It is the contractor’s responsibility to check and report any discrepancies in dimensions or measurements to CDP prior to any construction or building work starting.
CDP may agree to coordinate the ordering of products for the client’s design. CDP cannot be held responsible for arranging repairs, replacements, returns or freight claims for purchases. CDP will strive to select lights, furniture, and accessories from brands with good reputations; however, will not be held responsible for the quality of any lights, furniture or accessory that CDP select or propose.
All concepts, drawings and specifications prepared by CDP and all copyrights and other proprietary rights applicable thereto remain at all times CDP property. Project documents may not be used by the client for any purpose other than completion of the project.
Requests for additional design work or alterations to the design shall be assessed in conjunction with the client and may incur further design fees.
Either party may cancel the contract in writing at any time. In the event of cancellation, CDP will invoice for the services provided up to the date of cancellation.​
